Terms of service.
These terms and conditions constitute the agreement between you, (client) and PT. Siobhán Fionnuala Clothing trading as S&F Garment Manufacturing (manufacturer). EMERGING DESIGNER PACKAGES
Emerging Designer Packages are offered on our website only and require 100% payment up front before commencement.
S&F provides no guaranteed timeframe for completion of the emerging designer packs as finish dates will rely on input and communication from the client.
The client has 2 weeks from receiving the toile to make any changes/comments/ approve the toile including one revision as part of this package. (Platinum Package)
Any amendments to toile sample have to be submitted to the manufacturer in writing and all specification and tech packs updated, via email to designteam@siobhanandnuala.com. Requests for design alterations and or amendments to patterns that did not form part of the initial pattern design brief will incur additional charges.
The true sample is only included in the platinum emerging designer package. Should the client wish to proceed with a true sample and then small batch production they will need to approve a quote from our design team, approve an order docket and make payment. Terms and conditions for true sampling and production will be provided on a separate contract and are not included as part of this package
None of the following are included in this emerging designer package: fabric, special trim, artwork, dyeing, digital printing, screen printing, embroidery, custom fabric packaging and labels - including strike offs.
S&F reserves the right to add a surcharge to the design if it is a complicated design, as directed by our production team.
Add on designs booked at the time of the platinum package include services up to and including toile sample. True sample will be quoted separately per design and will be paid in full before commencement of sample.
The manufacturer once completed work paid for by the client is under no obligation to continue the relationship with the client should they choose.
All package services are available to the client, if the client chooses not to utillize included services no discount will be offered. FABRIC
S&F source fabric for all of our clients from our Indonesian suppliers. We make every effort to source a fabric as close as possible to the design brief, however we are limited to fabrics available in Indonesia.
S&F take no responsibility if a fabric suddenly becomes unavailable or is delayed.
S&F take no responsibility for any issues with any fabric, trim or services provide by third parties or import shipping agent.
PAYMENTS
All prices are quoted in USD$ unless indicated otherwise.
Payments need to be made in full upfront via our website or paypal link provided.
Payments are non-refundable.
MINIMUMS
Our standard minimums for production are 50 pieces or items per style in a single colour way or print and this includes a 3 size variation. Our total order minimum is 250 units. For children’s wear our MOQ is 100 units per style in a single colour way or print. This includes a 3 size variation. Total order minimum is 500 units.
We provide access to small run production for emerging designer clients at 25 pieces or items per style in a single colour way or print that includes a 3 size variation. This service must be booked no later than 1 month after the true sample is received and is only valid for design included in the package.
Add on designs at the time of booking the Platinum package will be eligible for small run production for included designs.
Production orders will be new work and will be quoted to you for approval before proceeding. S&F payment terms will apply under our normal terms and conditions.
All production bookings must be made 1 month prior to the commencement of manufacture, including small run production.
Bulk production space will not be held without prior approval and deposit.
Platinum Package small production run are not required to pay production deposit, and production may be held with prior approval.
SHIPPING
S&F will provide shipping as a service on our account at cost +10%. But it will not include custom duty tax on destination.
CONFIDENTIALITY
S&F do not disclose clients as a customer to other parties or clients unless otherwise agreed upon.
S&F do not disclose any monetary or order figures that the client places to any third parties, international government agencies or other clients without prior notification
S&F may ask the client for product images to be used for our portfolio. In this event we will only use such copyrighted images with the client’s written consent.
S&F will not sell or publish any client material, products or prints unless given written consent.
S&F will never reproduce the client’s particular produce/style/item for another client or related competition.
S&F ensure that copyright issues are upheld on our end, however take no responsibility for bad practices taken out by third party suppliers such as fabric printers and couriers.
By making payment the client acknowledges they have understood the terms and conditions contained in this agreement. Thank you for your business.
Clients are welcome to visit the S&F Bali factory with prior arrangement, however images in any format are strictly prohibited.
